Temporary Food Establishments & Farmers Markets
Do I need a permit?
Most people serving food at an event will need a Temporary Food Establishment Permit. The permit you need is determined by the type of event you are attending and the food you plan to serve.
Some simple, low risk foods are permit fee exempt, but you must still submit an application so we can confirm the exempt status.

Temporary Food Permits - What You Need to Know.
Determine Your Menu Type
Fee-Exempt Menu
For low-risk foods that don't need temperature control (examples: Packaged snacks, certain baked goods). You must still apply so we can confirm the exemption. Fee-Exempt Menu items include (WAC 246-215-08305):
Non-TCS fruit and vegetable samples
Popcorn made from commercially packaged ingredients
Dried herbs and spices from an approved facility
Crushed-ice drinks made only with non-TCS ingredients (self-contained machines that produce their own ice only)
Corn on the cob
Whole roasted peppers
Roasted nuts (including candy-coated)
Chocolate-dipped prepackaged ice cream bars
Chocolate-dipped bananas (prepared in an approved facility)
Cotton candy
Limited Menu
A temporary food event vendor menu shall be classified as Limited Menu when food handling activities do not exceed the following processes:
Preparation and service of cold-held foods (excluding any raw animal proteins).
Heating for immediate service of commercially prepared, fully cooked foods.
Hot holding of commercially prepared, fully cooked foods.
Complex Menu
A temporary food event vendor menu shall be classified as Complex Menu where food handling activities include one or more of the following processes:
Hot holding of TCS foods
Raw animal proteins for immediate consumption
Cooking of raw animal proteins to destroy pathogens
Cooling of TCS Foods
Determine Your Permit Category
Single Event Permits
Required when you serve food at one event. A Single Event can run 1-21 consecutive days. Examples are County fairs, parades, or cultural festivals.
Recurring Event Permits
Required if you serve food at an event lasting between 1-3 days a week on a repeating schedule. Examples are school sports season concession stands, flea markets/community markets.
Farmers’ Market
Required if you prepare or serve food at an authorized Farmers’ Market
This permit is only valid at Farmers’ Markets meeting the requirements of WAC 246-780-010.
Each Farmers’ Market will require its own permit.
Your first Farmers’ Market permit is full fees. Each additional Farmers’ Markets Permits purchased at the same time are discounted 50%.
Does my bake sale need a temporary food establishment permit?
Non-profit organizations operating for religious, charitable or educational purposes may hold bake sales with homemade baked goods not requiring temperature control. You must individually wrap items. A clearly visible sign at the point of sale must read, “Food was prepared at a kitchen not inspected by the Health Department.” Such bake sales do not need a permit WAC 246-215(C)<viii).
How early should I apply for my event permit?
Apply for your permit at least 14 days prior to the event.
If you apply late (between 13 and 3 business days prior to the event) a 25% late fee will be added.
Permit applications submitted less than 2 business days prior to the event will not be accepted.
What if I fail to obtain a Permit before I operate?
Any vendor identified operating without a permit will be required to shut down and stop operation. There are no exceptions to this requirement.

You may also need:
Commissary Kitchen Agreement (if you are making food at an approved kitchen but serving in another).
Wastewater Disposal Agreement (if you need to dispose of wastewater away from the vending location).
Restroom Agreement (if you need access to someone else’s restroom).

Once You Have Your Temporary Food Permit
Follow these rules when operating.
Email us at food@kitsappublichealth.org if you cancel or change your hours of operation.
Post your permit when operating.
Reapply to change your menu.
